Terms of Service

Welcome to Overseer. By accessing, purchasing, subscribing to, or using Overseer, including our website, Discord bot, Discord community tools, dashboard, and related services, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not use our services.

1. General

These Terms of Service govern your access to and use of Overseer and all associated services.

By creating an account, purchasing a subscription, inviting the bot to a Discord server, or using any Overseer feature, you acknowledge that you have read, understood, and agreed to these Terms.

We reserve the right to modify these Terms at any time. Continued use of Overseer after changes are posted constitutes acceptance of the updated Terms.

2. Accounts & Access

You are responsible for maintaining the security of your account and any credentials used to access Overseer.

You are responsible for all activity that occurs under your account.

You must provide accurate and up-to-date information when creating or managing your account.

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms or are used in a manner that may harm Overseer, its users, or third parties.

3. Purchases, Subscriptions & Delivery

Overseer may offer paid products, subscriptions, licenses, premium features, or Discord community features.

Access to purchased products or services is generally provided after successful payment processing. While we aim to provide access promptly, immediate activation is not guaranteed.

Subscription services remain active for the duration of the purchased billing period unless canceled, terminated, or otherwise restricted under these Terms.

An expired or disabled license restricts access to licensed features until a valid renewal is activated.

4. Discord Bot & Server Permissions

Overseer currently provides a Discord bot and related website features. You must have authority to invite and configure the bot in a Discord server and are responsible for the permissions you grant and the moderation actions you request.

A valid license may unlock the invite flow, but viewing a key or inviting the bot does not activate it. A key is activated once for one Discord guild and cannot be transferred. Subscription time starts on activation. Renewal requires a new key. When a subscription expires or is disabled, the bot may remain in the guild while licensed features are locked.

Overseer does not own your Discord server. Discord permissions and availability can affect the features that work. You are responsible for reviewing bot settings and informing your members about the features you enable.

5. Acceptable Use

You agree not to:

• Use Overseer for unlawful purposes.
• Attempt to gain unauthorized access to systems, accounts, or data.
• Disrupt, overload, or interfere with the operation of Overseer.
• Reverse engineer, exploit, or abuse the platform.
• Engage in fraudulent transactions, payment disputes without cause, or chargeback abuse.
• Use Overseer to violate Discord’s terms or those of another third-party service.

Violation of this section may result in immediate suspension or permanent termination without refund.

6. Refund Policy

Refunds may be granted under the following circumstances:

• A purchased service is not delivered within the stated timeframe.
• A service is substantially non-functional and cannot be reasonably resolved.
• A duplicate payment was processed.

Refund requests must be submitted within 7 days of purchase.

Refunds will not be issued for:

• Change of mind.
• User configuration errors.
• Failure to understand product functionality prior to purchase.
• Violations of these Terms.
• Service interruptions caused by Discord, payment providers, hosting companies, or circumstances outside our control.

All refund decisions are made at Overseer's sole discretion where permitted by applicable law.

7. Service Availability

We strive to maintain reliable service availability; however, we do not guarantee uninterrupted operation.

Maintenance, updates, technical issues, third-party outages, network failures, and unforeseen events may temporarily affect service availability.

Overseer may modify, suspend, or discontinue features at any time.

8. Disclaimer of Warranties

Overseer and all related services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, availability, accuracy, and non-infringement.

We do not guarantee that services will be uninterrupted, error-free, secure, or free from defects.

9. Limitation of Liability

To the maximum extent permitted by law, Overseer, its owners, developers, affiliates, and service providers shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our services.

This includes, but is not limited to:

• Loss of revenue.
• Loss of profits.
• Loss of data.
• Server downtime.
• Account suspension.
• Third-party actions.

Our total liability shall not exceed the amount paid by you for the affected service during the preceding 30 days.

10. Termination

We reserve the right to suspend or terminate access to Overseer at any time for violations of these Terms, suspected abuse, security concerns, payment disputes, or any activity that may negatively impact the platform.

Termination may result in the loss of access to certain features, data, or services.

11. Amendments

We reserve the right to update, modify, or replace these Terms at any time.

Updated versions will become effective upon publication on the Overseer website.

It is your responsibility to review these Terms periodically.
